2008 N-Hibit® & ProAct™ Satisfaction Guarantee Program Rules

Plant Health Care, Inc.® (PHC®) will issue a refund for the full purchase price of the N-Hibit and/or ProAct applied to any cotton, corn, or soybean acreage in 2008 where the end-user (farmer) is less than satisfied with the performance of N-Hibit® and/or ProAct™.  Refunds under the terms of this program will be paid via check from PHC, issued joint-payable to the RETAILER from whom the N-Hibit and/or ProAct was purchased and the FARMER, subject to the following conditions:

  • Refunds will only be paid on harvested acres that were treated with N-Hibit and/or ProAct.
  • Farmer must provide PHC with proof-of-purchase and proof-of-payment for all N-Hibit and/or ProAct purchases. 
  • Farmer requests for refunds under the terms of this program must be submitted in writing to PHC, and received by PHC at the address shown below, no later than November  15, 2008. However, for treated acres that are located north of I-80, or on treated cotton acres that are located in KS, OK, or in NM or TX if located north of Andrews County, TX, the deadline for requesting a refund under the terms of this program is December 1, 2008.
  • The retailer from whom the N-Hibit and/or ProAct was purchased must verify by signature the farmer’s claim of “less than satisfied” on the treated acreage for which a refund is requested.
  • Requests for refunds received after November 15, 2008 (or December 1, 2008 if applicable as detailed above) will be disallowed. 
  • It is solely the end-user’s/farmer’s responsibility to confirm that requests for refunds are submitted prior to the expiration of the submission deadline.
  • Claims under this program are expressly limited to a refund of the purchase price paid for the product used to treat the dissatisfied acres.  No further warranties or remedies are expressed, implied, or available.
